AN ACT PROHIBITING THE USE OF AN UNMANNED AERIAL 8 DEVICE THAT IS EQUIPPED WITH A VIDEO RECORDING DEVICE EXCEPT WHEN USED BY A LAW ENFORCEMENT AGENCY OR AUTHORIZED EMERGENCY PERSONNEL; AND FOR OTHER PURPOSES.

PROHIBITING THE USE OF AN UNMANNED AERIAL DEVICE THAT IS EQUIPPED WITH A VIDEO RECORDING DEVICE EXCEPT WHEN USED BY A LAW ENFORCEMENT AGENCY OR AUTHORIZEDEMERGENCY PERSONNEL. BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: SECTION 1. Arkansas Code Title 5, Chapter 60, Subchapter 1,
is amended to add a new section to read as follows: 5-60-103. Unlawful use of an unmanned aerial device equipped with a video recording device.
(a) A person commits the offense of unlawful use of an unmanned aerial device equipped with a video recording device if:
(1) He or she knowingly operates an unmanned aerial device equipped with a video recording device with the purpose of recording another person or another person’s property; and
(2) Without the other person’s consent.
(b) It is a defense to prosecution under this section if:
(1) The person operating the unmanned aerial device is:
(A) A law enforcement officer or person operating the unmanned aerial device at the request of a law enforcement officer; or
(B) An employee of an entity that provides emergency assistance or person operating the unmanned aerial device at the request of an employee of an entity that provides emergency assistance; and
(2) The person is operating the unmanned aerial device as part of his or her official job duties.
(c) Unlawful use of an unmanned aerial device equipped with a video recording device is a Class C felony.
